Employer of Record in Spain: The Best and the Rest

110 providers that employ staff in Spain — 44 Spain-focused specialists and 66 global providers with Spain coverage. Facts with a logged source, nothing else.

Section 1

Overview

Hiring in Spain through an Employer of Record lets your company employ local talent without first incorporating a Spanish company. The provider becomes the employee’s legal employer and handles the employment contract, Seguridad Social registration, payroll and IRPF withholding, while your company directs the work through its agreement with the provider.

In Spain, the legal model deserves as much attention as the price. Spanish law reserves the supply of workers to a client to licensed temporary-work agencies (ETTs), and only for temporary needs, so how a provider structures the employment affects the risk of illegal worker cession. You should also understand the full cost, including 14 salary payments and dismissal costs.

TheEORDirectory’s guide brings together EOR providers serving Spain in alphabetical order. It begins with a selection of prominent providers, also arranged alphabetically, followed by the full directory. Neither list is a ranking: the right choice depends on your hiring plans, budget and support requirements.

Section 2

How to Compare Spanish EOR Providers

Start with the legal employer. Providers in Spain generally use one of three models:

  • Own Spanish SL: the provider’s subsidiary employs the worker and presents the arrangement as a service.
  • Licensed ETT: an agency assigns the worker to you as the user company, within agency-law limits.
  • Local partner: a third-party Spanish company employs the worker on the provider’s behalf.

Ask for the full name and CIF (tax identification number) of the company that will sign the contract, and check it in the Mercantile Register (BORME). If the provider says it acts as an ETT, ask for its authorisation number and confirm it in the Ministry of Labour’s public ETT register. If a partner is used, establish who handles payroll, employee queries and disputes.

Request an itemised quote for the specific employee, covering the fee, contributions, extra payments, deposits, benefits and any setup or termination charges. Finally, ask who will support the employee locally, in Spanish and English.

Section 3

How an Employer of Record Works in Spain

The provider signs a contract under the Workers’ Statute, registers the hire with the Seguridad Social, runs payroll and withholds IRPF and employee contributions. Key features include:

  • Contracts: since the 2021 labour reform (Royal Decree-law 32/2021), indefinite contracts are the default. Fixed-term contracts are limited to production needs (up to six months, or one year by collective agreement) or replacing an absent worker.
  • Tax: IRPF is progressive, with combined state and regional rates from 19% to about 47%. Qualifying inbound workers may opt for the 24% impatriate regime.
  • Pay: salary is usually paid in 14 instalments: 12 monthly payments plus two extra payments, which can be prorated if the collective agreement allows.
  • Collective agreements: most roles fall under a sectoral or company convenio colectivo setting minimum pay, hours and benefits.
  • Leave: at least 30 calendar days of paid holiday plus up to 14 public holidays.
  • Probation: up to six months for qualified technicians and two months for other staff for other staff, and one month on fixed-term contracts of up to six months.
  • Dismissal: objective dismissal carries 15 days’ notice and severance of 20 days’ salary per year of service (capped at 12 months). Unfair dismissal costs 33 days per year (capped at 24 months).

The bill to cut the week to 37.5 hours was rejected by Congress in September 2025, and no replacement had been passed by October 2026, so the maximum stays at 40 hours.

Section 4

ETT Rules and Illegal Worker Cession

Under Law 14/1994, only an authorised ETT may hire workers in order to assign them to a user company:

  • Temporary needs only: an ETT assignment is allowed only where the user company could itself sign a fixed-term contract, so it does not cover an open-ended role.
  • Equal pay: assigned workers must receive at least the pay set by the user company’s collective agreement for the same role.
  • Exclusions: no replacing strikers, specified hazardous work or, for 12 months, posts cut through dismissals.

Outside the ETT framework, article 43 of the Workers’ Statute prohibits illegal worker cession. A cession is illegal where the supplier has no real organisation of its own, does not act as employer or simply places staff at the client’s disposal.

The provider and the client are jointly and severally liable for wages and Seguridad Social contributions. The worker may choose to become a permanent employee of either company, and inspectors can impose fines for a very serious infringement. Ask any provider using its own SL how it organises and directs the work,.

Section 5

Contracts Beyond Employment

Some providers propose contractor models instead of employment:

  • Autónomo: the worker registers as self-employed with the tax agency and the RETA scheme of the Seguridad Social, pays contributions based on real net income and invoices your company.
  • TRADE: an economically dependent self-employed worker who earns at least 75% of their income from one client. Under the Self-Employed Workers’ Statute, the contract must be written and registered, with 18 working days of rest and compensation for unjustified termination.

Courts look at substance, not labels: work under your direction, within your organisation and for a regular fee is likely employment. This is the falso autónomo risk.

If an inspection reclassifies the contract, the business can owe back contributions with surcharges, plus fines, and the worker can claim employment rights, including severance. Ask any provider proposing this model how it assesses the risk.

Section 6

What an EOR Costs in Spain

The monthly service fee is only one part of the budget. The total includes gross salary, employer contributions, the EOR fee and any benefits.

For an indefinite contract in 2026, employer contributions to the Seguridad Social total roughly 30.65% of the contribution base plus the workplace accident rate. The rates include 0.75% for the Intergenerational Equity Mechanism (MEI), part of a 0.90% total. The maximum contribution base is EUR 5,101.20 a month, with a solidarity contribution from 1.15% on pay above it. The minimum wage (SMI) is EUR 1,221 a month over 14 payments (EUR 17,094 a year) for 2026.

Published fees vary. Spanish specialist SpainWork lists EUR 195 a month and Tarmack $199, RemotePeople starts from $199 under its EOR Select plan in selected countries, and Deel’s published price is about $599 per employee per month.

For illustration, assume a gross salary of EUR 45,000 a year, employer contributions of about 32.15% including a 1.5% accident rate, and an EOR fee of EUR 500 a month:

Cost componentAnnual amount
Gross salary (14 payments)EUR 45,000
Employer Seguridad Social (about 32.15%)EUR 14,468
Assumed EOR service feeEUR 6,000
Illustrative annual totalEUR 65,468

This is a budgeting example, not a provider quote. Benefits and severance would increase the total.

Section 7

The Hiring Process and Work Permits

EU, EEA and Swiss citizens need only an NIE (foreigner identity number) and Seguridad Social number, and can often start within two weeks. Others usually need a permit:

  • Highly qualified professional (HQP): a residence authorisation under Law 14/2013, processed by the UGE-CE in about 20 working days, subject to a salary threshold.
  • EU Blue Card: for qualified professionals with a contract of at least six months and pay above the threshold.
  • Digital nomad visa: created by Law 28/2022 for remote work for employers or clients outside Spain, with income of at least 200% of the SMI (about EUR 2,849 a month in 2026). It does not cover employment by a Spanish EOR.

A new immigration regulation, Royal Decree 1155/2024, took effect on 20 May 2025. It lengthened initial permits and reformed the job-seeking and roots routes. Check that the provider can sponsor the permit each hire needs, and how long it will take.

Section 8

Questions to Ask Before Signing

  • Which Spanish company will employ the worker, and what is its CIF?
  • Is it an authorised ETT, your own SL or a local partner, and how do you avoid illegal worker cession?
  • Will the employee have an indefinite employment contract rather than an autónomo arrangement?
  • Which collective agreement applies, and what minimum salary and benefits does it set?
  • What is the complete annual cost, including both extra payments, Seguridad Social, benefits and deposits?
  • Can you sponsor the work permit this hire needs, and how long will it take?
  • What severance and charges apply on termination or a move to direct employment?

Clear answers make it easier to compare the providers in the directory and choose an arrangement that fits both your immediate hire and your longer-term plans.

Deel

San Francisco platform (2019) with three Madrid companies on the register: LetsDeel Spain SL (B09984311), Ldeel Proll SL and Deel Global Payroll Spain SL, the ex-Safeguard payroll arm. Deel does not say which signs EOR contracts, and none is in the ETT register. EOR from $599 per month, month-to-month, with Unisure, Allianz and Cobee benefits; G2 4.7/5 (7,380) and Trustpilot 4.6/5 (9,733).

✓ Strengths in Spain

  • Verifiable Spanish footprint: three Madrid companies directly linked to Deel on the Registro Mercantil, with founder and CEO Alex Bouaziz as director of all three and Deel Inc as sole shareholder of LetsDeel Spain SL.
  • Published entry price of $599 per employee per month on month-to-month terms with no long-term commitment, and Spain-specific add-on charges (PRL training, employer liability fee) itemised on the Spain page.
  • Broad platform covering EOR, payroll for own entities, contractors, HRIS, benefits, immigration and IT equipment, which suits companies hiring in several countries at once.
  • Named Spanish benefit partners (Unisure, Allianz, Cobee) for private health cover and tax-efficient flexible remuneration.

✗ Watch out for

  • Deel does not name the Spanish company that employs EOR staff, and none of its three Spanish NIFs appears in the public ETT register, so the legal basis for supplying workers to clients should be checked before signing.
  • Its entry price of $599 per month is higher than the published starting prices of several other providers in this comparison.

HirelySpain

Barcelona boutique run by In Life Projects SL (CIF B67383232, incorporated 2019, €3,000 capital), founded by Lydie Hubert and director Juan Carlos Ruiz. It combines IT and digital recruitment with EOR, covering contracts, payroll and Spanish and Catalan tax and Social Security. Pricing is quote only. The company's registered purpose is sports and IT consultancy, it is not in the ETT register, and no reviews were found.

✓ Strengths in Spain

  • Small founder-led team in Barcelona, with both founders named and Juan Carlos Ruiz as the registered director, which gives clients direct access to the people running the service.
  • Recruitment and EOR from one provider, with a focus on Spanish IT and digital talent.
  • A transparent cost structure: gross salary, employer Social Security and Hirely's margin are listed separately, with optional costs such as coworking named.
  • Local knowledge of Catalan as well as Spanish tax and social contribution rules.

✗ Watch out for

  • The employing company's registered purpose is sports instruction plus IT consultancy, with nothing on staffing. Neither In Life Projects SL nor Hirely appears in the ETT register, so the basis for supplying workers to client companies should be checked.
  • The website address (Ronda de Sant Pere 40) does not match the registered office (Rosselló 157), and the legal notice omits the Registro Mercantil details normally included.

RemotePeople

New York EOR founded in 2018 by Antoine Boquen and Pierre Pradier. It employs and recruits in Spain, with Spanish contracts, TGSS registration and 14-payment IRPF payroll, and sponsors HQP and EU Blue Card permits. EOR Select is from $199 for eligible countries and salaries and EOR Global from $499, with fees confirmed in the proposal. The Spanish entity is not named. G2 4.7/5 (454), Capterra 4.9/5 (72).

✓ Strengths in Spain

  • Published pricing, with EOR Select from $199 and EOR Global from $499, plus prices for recruitment, contractors, payroll and legal help, where many EOR providers quote only on request.
  • A detailed Spain page with a worked employer-cost example, 2026 contribution rates, contract rules after the 2021 reform, termination and severance rules, and a step-by-step onboarding timeline.
  • Immigration routes are set out explicitly: HQP permits in about 20 working days, EU Blue Card and standard work authorisation sponsorship, plus guidance on the digital nomad visa.
  • Recruitment, EOR, Contractor of Record, payroll and SL incorporation with EOR-to-entity transfer from one provider.

✗ Watch out for

  • The Spain page does not name the Spanish employing entity, its CIF or its address, and no ETT authorisation under the RemotePeople name appears in the public register, so buyers need the proposal to confirm the model.
  • Whether a Spanish hire qualifies for the $199 EOR Select tier is decided case by case. The Spain page's own fee ranges are inconsistent ($300 to $600 against $500 to $900), so the real Spanish fee is only clear in the proposal.

Safeguard Global

Austin-based EOR, founded in 2008, that employs Spanish staff through its own Safeguard Global ETT SL (B87646451, Paseo de la Castellana 143, Madrid), a licensed temporary-work agency under authorisation 73/0222/22. Its sole shareholder is ADM IN STAFF SA, the Swiss company Safeguard bought in 2019. Pricing is by quote only. Its Spanish payroll company passed to Deel in 2025. ✓ Strengths in Spain

  • Employs through its own Spanish company, Safeguard Global ETT SL (B87646451, Madrid), which is listed in the Ministry of Labour's ETT register under authorisation 73/0222/22, the structure Spanish law requires for supplying workers to a client company. Few global EORs hold this licence in their own name.
  • The ownership chain can be checked: the ETT's sole shareholder, ADM IN STAFF SA, is the Swiss WorkFor Group company Safeguard bought in 2019, and group founder and CEO Bjorn Reynolds has been the Spanish company's sole director since 2021.
  • Long EOR track record: payroll since 2008 and EOR since 2009 (provider claims), with in-country Spanish operations since the 2016 WorkFor company and expanded in 2022.
  • Broad service range around the Spanish hire, including recruitment, benefits design, immigration guidance, contractor management and entity setup, with a published Spain hiring guide covering contracts, payroll, leave and dismissal.

✗ Watch out for

  • No published Spain pricing or setup fee; EOR is quote-only, so it is harder to compare costs than with providers that publish rates.
  • The 2025 sale of the payroll division moved Safeguard's Spanish payroll company to Deel (now Deel Global Payroll Spain SL). Clients should confirm which Safeguard company, the ETT, employs and pays their staff, and how in-house Spanish payroll is now delivered.

Softlanding

Lisbon-based Iberia expansion service operated by Brightwizard S.A., the former parent of Landing.Jobs, offering EOR, Agent of Record, customer-success recruitment, PEO and visas for Portugal and Spain. It says it hires through a local entity, but no Spanish company, CIF or ETT authorisation could be found, and pricing is not published (10% of cost, EUR 300-600, in a 2023 proposal). ✓ Strengths in Spain

  • Iberia specialist that combines EOR, contractor management, recruitment, setup and relocation, aimed at companies building a first team in Portugal or Spain.
  • A clear niche in customer-success hiring, with webinars and a talent report, plus team augmentation that promises shortlists within 48 hours.
  • Its pricing model, as shown in a 2023 client proposal, is simple and capped: 10% of worker cost with a EUR 300 minimum and EUR 600 maximum per month, plus fixed fees for visas and setup.
  • Recruitment pedigree through the Brightwizard group, former owner of Landing.Jobs, and named international clients including Grover, OutSystems, Amyris and Synopsys.

✗ Watch out for

  • The Spanish employing entity is not disclosed, and the directory found no Spanish company linked to Brightwizard or Softlanding and no ETT authorisation in the Ministry of Labour register, so the Spanish employment structure is unverified.
  • The service is Portugal-led: the legal operator, address, visa guidance and most case studies are Portuguese, and no Spanish office or Spain-specific case study is published.

SpainWork (Strong Abogados)

SpainWork is the EOR service of Strong Law and Compliance (Strong Abogados), a family-owned Spanish legal, tax and payroll firm with offices in Madrid, Barcelona and Tenerife. It publishes a flat EUR 195 per employee per month, with visas and Beckham Law in-house. The employing entity is not named: a Florida LLC's Madrid branch (W0402435B) and a Madrid SL (B44642593) are registered, and neither holds ETT authorisation.

✓ Strengths in Spain

  • The lowest published Spain EOR price the directory found: a flat EUR 195 per employee per month, nothing charged to employees, and a public cost calculator.
  • A Spain-only, family-owned legal, tax and payroll practice with offices in Madrid, Barcelona and Tenerife, founded in the early 2000s, with legal, payroll, immigration and tax staff in-house.
  • Immigration and Beckham Law in-house, useful for relocating non-EU hires and expatriates who qualify for the special tax regime.
  • Fast stated onboarding, within 24 hours of Seguridad Social registration, with payslips and contracts delivered through its own Tempo portal and Sistema RED filing.

✗ Watch out for

  • The Spanish employing entity is not named on the EOR pages. Two registered candidates exist, a Florida LLC branch registered only in April 2026 and a Madrid SL, so clients should obtain the employer's name and CIF in the contract.
  • No ETT authorisation was found for either company in the Ministry of Labour register. Supplying workers to a user company without one can be treated as unlawful assignment of workers (cesión ilegal) under article 43 of the Workers' Statute, so the legal structure should be reviewed.

Tarmack

✓ Strengths in Spain

  • Publishes a low headline price, from $199 per employee per month for EOR, alongside prices for contractor management ($39), payroll ($15 per payroll), recruiting (10%) and immigration ($999), where many competitors quote only on request.
  • The person behind it can be identified in an official register: Pranaya Chulet, listed by Crunchbase as co-founder and CEO and known as the founder of Quikr, has been a director of Tarmack Limited at Companies House since May 2023.
  • Offers a wide range of services for Spain from one platform: EOR, standalone payroll, autónomo contractor management with conversion to employment, Highly Qualified Professional, Blue Card and digital nomad permit support, recruiting and SL formation.
  • The Spain page covers the main legal frameworks (Estatuto de los Trabajadores, LGSS, LPRL, the 2021 labour reform) and states dismissal compensation correctly: 33 days per year capped at 24 months for unfair dismissal and 20 days capped at 12 months for objective dismissal.

✗ Watch out for

  • The Spanish employing entity is not disclosed and no Tarmack company was found in Spanish company registers, so the service most likely relies on an unnamed partner whose CIF, financial standing and ETT authorisation cannot be checked before signing; without an authorised ETT, an arrangement where the client directs the worker risks being treated as illegal assignment of workers (cesión ilegal).
  • The Spain page has substantive errors: 16 days of paternity leave and 'unpaid' maternity leave (birth leave is 19 paid weeks per parent since Real Decreto-ley 9/2025), the 2025 minimum wage presented as the 2026 rate, a 30-minute break rule, 100% sick pay from day 30 and a Macau GDP line copied from another page.

TCWGlobal

San Diego contingent workforce firm founded in 2009 as TargetCW by CEO Samer Khouli, offering EOR, third-party payrolling, MSP programmes and its StaffingNation VMS. Its Spain page covers EOR for contingent workers, but no Spanish entity was found and the legal employer is not named, so a partner is likely (unverified) and ETT status cannot be checked. ✓ Strengths in Spain

  • Long-established US workforce business: founded in 2009 by its current CEO Samer Khouli, with a named Chief Compliance Officer and General Counsel and a San Diego headquarters, so the contracting party is an experienced firm rather than a start-up.
  • Strong for enterprise contingent workforce programmes, combining EOR, third-party payrolling, MSP services and its own StaffingNation VMS under one supplier, which suits companies that want Spanish workers on the same platform and invoice as their US contractors.
  • The Spain page states several core rules correctly, including 30 calendar days' vacation, the 80-hour overtime cap, sick pay at 60% and 75% from Social Security, probation limits and the 18-in-24-month conversion to permanent status.
  • Quotes are itemised: international quotes separate gross salary, employer costs and TCWGlobal's support package before showing a total mark-up percentage, so the cost build-up is visible before signing.

✗ Watch out for

  • No Spanish entity was found and the Spanish legal employer is not named, so Spanish staff are most likely employed by an undisclosed partner; clients should ask who signs the employment contract, who is registered with the Seguridad Social and the partner's CIF.
  • ETT authorisation cannot be checked without a named Spanish employer. If workers are supplied to work under the client's direction, the employer must be an authorised ETT to avoid illegal assignment of workers (cesión ilegal), so the partner's ETT registration should be requested.

✓ Strengths in Spain

  • Employs through its own long-established Spanish company. Vasalto Tech and Talent, S.A. can be checked in the Madrid commercial register (hoja M-167452, incorporated 1996, share capital about EUR 970,000), and its sole administrator is also the Director General.
  • A large in-house Spanish payroll operation: it claims 30,000+ payrolls a month overall and 5,900 under its EOR model, with detailed handling of IRPF, Social Security filings, Contrat@ and collective agreements.
  • Covers immigration in-house, including NAFF work authorisations for EU and non-EU staff, renewals and TA-300 secondments, which many local EORs pass to third parties.
  • Payroll, accounting, tax and legal advice come from one team, with bilingual Spanish/English service, a dedicated account manager and reporting for foreign parent companies. This also eases a later move to a client's own Spanish entity.

✗ Watch out for

  • Vasalto does not claim ETT (temporary-work agency) authorisation, and its registered business purpose is advisory. Spanish law generally restricts supplying workers to authorised ETTs, so the legal structure of the EOR arrangement should be confirmed before signing.
  • Pricing is not published: the EOR fee, any setup fee and any deposit are set only in a tailored proposal.

✓ Strengths in Spain

  • Backed by an established UK group: Workwell People Solutions Limited dates from 1989 (formerly JSA Services Limited), has institutional investor Universal Partners on its board, and was named a Leader in Everest Group's 2026 Contractor of Record and Contingent EOR assessment.
  • It has a real operational presence in Spain. Barcelona is one of its service hubs, and both its international operations director and head of international operations work there.
  • Register checks show group-owned Spanish companies, WhiteFin Contracting Solutions SL (capital EUR 103,000, group-owned since 2023) and an ETT-purpose subsidiary. That points to an in-house Spanish structure rather than a third-party partner, though the link has not been confirmed.
  • Strong in contractor and contingent-worker engagement for recruitment agencies, with in-house legal expertise and contractual indemnification cited by Everest Group.

✗ Watch out for

Websites that are not independent Spain EORs

3 checked

Sites that market Employer of Record services in Spain but, on the public record, are either a landing page for a provider already listed or cannot be tied to an identifiable operator. Listing a site here is a statement about what its pages disclose, not about the quality of any service.

employerofrecord-spain.com ↗

Brand site of Agility EOR

EOR Spain carries the footer "Copyright 2026 EOR Spain" but loads the same HubSpot account as agilityeor.com and follows the same design and copy as Agility's UK, German and Portuguese landing sites. A legitimate landing page, but not a distinct provider: it is Agility EOR, which is listed in the full directory.

Operated by → Agility EOR fact sheet

employerofrecordspain.com ↗

Brand site of Hightekers

Spanish Employer of Record links in its footer to Hightekers and uses Hightekers B.V.'s own privacy policy, the same set-up as Hightekers' Dutch and Portuguese front sites. Not a distinct provider: it is Hightekers, now part of the Rivermate group, which is listed in the full directory.

Operated by → Hightekers fact sheet

spaineor.com ↗

Expandyte network; not an EOR

Spain EOR is part of the Expandyte network, which does not offer Employer of Record services itself and, by its own declaration, is an entity set-up service. It is not an independent Spanish Employer of Record.

Not an Employer of Record: Expandyte network.
