Section 1

Overview

Hiring in Germany through an Employer of Record can help your company employ local talent while you decide whether to establish a German entity. The provider becomes the employee’s legal employer and handles the employment contract, payroll and statutory registrations, while your company directs their day-to-day work.

Choosing a provider means looking beyond its monthly fee. Germany’s labour-leasing rules make the employing entity, its AÜG licence and the permitted assignment duration central to the decision. You should also understand the full employment cost, the support available to your employee and how the arrangement can transition to direct employment.

TheEORDirectory’s guide brings together EOR providers serving Germany in alphabetical order. It begins with a selection of prominent providers, also arranged alphabetically, followed by the full directory. Neither list is a ranking: the right choice depends on your hiring plans, budget and support requirements.

Use the directory to explore your options, then compare providers on the same practical questions: who will employ your hire, what is included in the quote, how German employment matters are handled and what happens when the assignment reaches its permitted limit.

Section 2

How to Compare German EOR Providers

Start with the legal employer. Ask for the full name of the entity that will sign the employment contract and evidence of its current labour-leasing licence. If a provider uses a local partner, identify that partner and establish which organisation handles payroll, employee queries and contractual disputes.

An owned entity and a partner arrangement can offer different service experiences. Assess the actual employment structure, the division of responsibilities and the quality of local support alongside the provider’s brand and software.

Request an itemised quote for the specific employee. Check the service fee, employer contributions, deposits, optional benefits, currency conversion and any setup, termination or transition charges. Confirm which amounts are fixed, estimated or refundable.

Finally, ask who will support the employee in Germany. A named local contact, clear response times and experience handling leave, sickness and termination are useful points to compare.

Section 3

How an Employer of Record Works in Germany

In a standard EOR arrangement, the provider employs a worker who is integrated into your company’s organisation and works under your direction. This generally falls within Germany’s employee-leasing framework, governed by the Arbeitnehmerüberlassungsgesetz, commonly called the AÜG.

The employing entity needs the appropriate licence from the Bundesagentur für Arbeit. Your commercial relationship with the provider must also reflect the actual employee-leasing arrangement. A licence held by another company in the same group should not be assumed to cover the entity employing your worker. Source: Bundesagentur für Arbeit

Two contractual relationships underpin the hire:

  • The employment contract: between the employee and the employing entity, covering salary, working hours, leave, notice and other employment terms.
  • The employee-leasing agreement: between your company and the licensed provider, covering the assignment and each party’s responsibilities.

The EOR handles employment administration, but your company retains responsibilities as the business directing the work. Workplace health and safety obligations, for example, also apply to the client. Establish the division of duties before the employee starts. Source: AÜG §11

Section 4

Assignment Duration and Equal Treatment

The general statutory limit is 18 consecutive months for the same employee with the same client. Qualifying collective arrangements can permit a different duration, so ask which limit applies to your proposed hire.

Changing EOR providers does not automatically restart the clock. Previous assignments to the same client count where the interruption is no more than three months. A break must therefore exceed three months for earlier assignments to stop counting under this rule.

The limit concerns the employee’s assignment to your company. It does not itself require the employee’s contract with the EOR to end after 18 months. Source: AÜG §1

Equal treatment, including pay comparable to that of an equivalent employee at the client, is the statutory starting point. Qualifying collective agreements can allow departures: pay-related exceptions generally cover the first nine months, with longer exceptions possible under specified conditions. Ask the provider how it establishes the applicable pay and employment conditions from the start. Source: AÜG §8

Section 5

The Hiring Process

Before agreeing a start date, confirm the employee’s right to work, the role, salary, workplace and expected assignment duration. The provider should explain the contractual structure and the checks needed for that particular hire.

The employing entity then prepares the employment contract, completes the necessary payroll and social-insurance setup and coordinates onboarding with your company. Once employment begins, the provider processes payroll and statutory payments while you manage the employee’s work.

Ask for a start date based on the candidate’s circumstances rather than a generic onboarding promise. Immigration eligibility deserves particular attention: where Federal Employment Agency approval is required, that approval must be refused for temporary agency employment. Visa support is therefore not simply an extra step that every EOR can complete. Source: Residence Act §40

Section 6

What an EOR Costs in Germany

The monthly service fee is only one part of the budget. The total includes gross salary, employer social contributions, applicable levies and accident insurance, the EOR fee and any agreed benefits or additional charges.

For most ordinary employees in 2026, the employer shares include 9.3% for pension insurance and 1.3% for unemployment insurance. Statutory health insurance normally includes 7.3% plus half the insurer’s supplementary contribution; the usual employer share of long-term care insurance is 1.8%, with different rules in Saxony. Contributions are subject to the relevant income ceilings. Source: Techniker Krankenkasse

Unemployment insurance

Health insurance

Long-term care
1.8%

Use a candidate-specific calculation rather than applying one percentage to every salary. The health insurer, salary, applicable ceilings and other payroll charges affect the result.

For illustration, assume an annual gross salary of €60,000, budgeted employer contributions and other statutory payroll costs of €14,000, and an EOR fee of €400 a month:

Cost componentAnnual amount
Gross salary€60,000
Assumed employer contributions and other statutory payroll costs€14,000
Assumed EOR service fee€4,800
Illustrative annual total€78,800

This is a budgeting example, not a provider quote or an exact payroll calculation. Optional benefits and one-off charges would increase the total. Treat a refundable payroll deposit separately from annual operating costs, while allowing for the cash required upfront.

Section 7

Planning for Longer Term Employment

Discuss the assignment’s end before signing. If the role is intended to continue beyond the applicable limit, agree when you will review the employment structure and what support the provider offers for a transition.

Potential options include employing the worker through your own German entity or assessing direct employment by your existing foreign company. The latter requires a review of German payroll, social insurance, employment obligations and the company’s tax position.

A break in the assignment may be another option where commercially practical, but it means stopping the employee’s assignment to your company. Changing the contract’s label or switching providers should not be treated as a substitute for reviewing the legal structure.

There is no universal headcount at which a GmbH becomes cheaper. Compare the EOR’s recurring fees and transition costs with entity setup, accounting, payroll, HR administration and the duration of your German operation. Salary and statutory employment costs remain part of either model.

Section 8

Questions to Ask Before Signing

  • Which legal entity will employ the worker, and can you provide its current AÜG licence?
  • Will you use your own entity or a local partner, and who handles employee support?
  • What assignment limit and equal-treatment rules apply to this hire?
  • What is the complete monthly cost, including additional charges and deposits?
  • Does the employee’s immigration status permit the proposed arrangement?
  • What happens if the assignment ends early or reaches its permitted duration?
  • What support and charges apply if we move the employee to direct employment?

Clear answers make it easier to compare the providers in the directory and choose an arrangement that fits both your immediate hire and your longer-term plans.
